Data Privacy

Compliance with data privacy laws is mandatory for all businesses.
 
A business' ability to transfer and use customer data and other information is required for the day-to-day running of a company and is vital for its profitability and success. With the introduction of new and more severe data privacy laws, in particular the EU General Data Protection Regulation (known as the GDPR), it is critical that businesses are fully informed and fully compliant.
 
We regularly advise clients on data privacy and confidentiality, especially in relation to the GDPR. There are strict penalties for non-compliance under the GDPR and the Information Commissioner’s Office can impose fines of up to 20 million Euros or 4% of group worldwide turnover (whichever is greater) against both businesses that are data controllers or data processors.
 
Our lawyers frequently advise clients on their GDPR compliance programmes and solutions. For example, we review a business' strategy and amend its’ contracts for:
  • justification of its processing of personal data; 
  • data policies and data transfer agreements for local and international transfers; and
  • outsourced processing of personal data.
We have deep litigation experience and deal with data protection authorities to support our clients through complaints, claims and investigations relating to data privacy and other issues across their businesses.
